1. About these Terms

These Terms of Service govern your access to and use of alivebrewing.sg, including purchases made through the website.

In these Terms, “Alive Brewing”, “we”, “us” and “our” refer to Alive Brewing Pte Ltd. “You” and “your” refer to the person accessing the website or placing an order.

By accessing the website or placing an order, you agree to these Terms. If you do not agree, do not use the website or place an order.

Our Return and Refund Policy, Shipping Policy, Privacy Policy and other policies made available through the website form part of these Terms where applicable.

2. Eligibility to use the website

You must have the legal capacity to enter into a binding agreement to place an order.

You may browse the website without creating a customer account. If you create an account, you are responsible for providing accurate information, protecting your login credentials and notifying us promptly of suspected unauthorized access.

You are responsible for activity conducted through your account except to the extent caused by our act or omission.

3. Alcohol age restriction

You must be at least 18 years old to purchase alcohol from Alive Brewing.

It is an offence for an individual younger than 18 years to buy or attempt to buy liquor. A person who commits this offence may be liable on conviction to a fine not exceeding S$10,000.

By confirming your age through the website’s age-verification process and placing an order containing alcohol, you declare that:

You are at least 18 years old;
The information you provide is accurate;
You are legally permitted to purchase alcohol;
You are not purchasing alcohol on behalf of an individual younger than 18 years; and
You will ensure that the delivery arrangements comply with applicable age requirements.

We may request further information or identification where reasonably necessary to verify age or comply with legal and licensing obligations. We may reject or cancel an order, or refuse delivery, where age requirements are not satisfied or we reasonably suspect that information supplied is inaccurate.

4. Liquor licensing

Alive Brewing holds Class 3A and Class 4 liquor licences for its applicable business activities.

Alcohol will be offered, sold and supplied subject to applicable Singapore law, licence conditions and permitted trading arrangements. Nothing on the website constitutes an offer or commitment to supply alcohol in circumstances prohibited by law or the conditions of an applicable licence.

5. Products and availability

Products displayed on the website are subject to availability.

Adding a product to your cart does not reserve it. A product may become unavailable before your order is accepted or fulfilled.

If an ordered product is unavailable, we may:

Contact you to discuss available options;
Cancel the unavailable item and refund the applicable amount; or
Cancel the order and issue an applicable refund.
We will not substitute a product without your agreement.

We aim to provide accurate product names, descriptions, quantities, alcohol content, ingredients and other material information. Customers with allergies or dietary concerns should review the ingredients and information printed on the product’s can, label or packaging before consumption. 6. Personal-use purchases

Consumer purchases through alivebrewing.sg are intended for personal use.

Products purchased through the consumer website must not be resold or commercially distributed without our prior written approval.

Wholesale, bar, restaurant, distributor and other business-to-business transactions are handled separately and may be subject to separate written agreements. If a separate written agreement applies, that agreement takes priority for the relevant business transaction.

7. Prices and GST

All prices displayed on alivebrewing.sg are in Singapore dollars unless expressly stated otherwise.

Prices include Goods and Services Tax where applicable.

Delivery charges and any other applicable charges will be displayed before you complete checkout.

We may change prices prospectively at any time. A price change will not affect an order that we have already accepted, except where there is an obvious pricing or technical error.

8. Pricing and website errors

We attempt to ensure that prices and other information are accurate. However, typographical, pricing, inventory or technical errors may occasionally occur.

If an obvious error affects an order, we may contact you for instructions or cancel the affected order before fulfilment. If payment has already been collected for a cancelled order, we will issue the applicable refund to the original payment method.

We will not knowingly enforce a price or term that is misleading or inconsistent with mandatory consumer rights.

9. Placing an order

To place an order, you must:

Select the products and quantities;
Provide accurate contact, billing and delivery information;
Complete the required age confirmation for alcohol;
Select an available delivery and payment method; and
Confirm the order through checkout.

You are responsible for checking the contents of your cart, delivery details and contact information before submitting the order.

An automated order-confirmation email acknowledges that we have received your order. It does not by itself guarantee that the order has been accepted or will be fulfilled.

We accept your order when we confirm fulfilment or dispatch, or otherwise expressly confirm acceptance. We reserve the right to reject or cancel an order before acceptance for a legitimate reason, including:

Product unavailability;
Payment failure;
Incorrect customer or delivery information;
Suspected fraud or unauthorized activity;
Suspected underage purchasing;
A pricing or technical error;
An order exceeding reasonable consumer quantities;
Suspected unauthorized resale; or
Legal, licensing or delivery restrictions.

If we cancel a paid order, we will issue the applicable refund in accordance with our Return and Refund Policy.

10. Payment

Payment must be authorized at checkout through one of the payment methods presented.

Payments may be processed by Shopify or another payment service provider. Alive Brewing does not directly retain complete payment-card details entered through the payment provider’s secure checkout.

Your use of a payment method may also be subject to the payment provider’s terms and privacy practices.

You confirm that you are authorized to use the payment method provided and that the payment information is accurate.

11. Discount codes

Unless separate promotional terms state otherwise:

Only one discount code may be used per order;
Discount codes cannot be exchanged for cash;
Discount codes cannot be applied retrospectively;
Discount codes cannot be combined;
Discount codes may be subject to expiry dates, product exclusions or minimum purchase requirements; and
We may reject a discount code that is invalid, expired, improperly used or obtained through unauthorized means.

We may issue separate terms for a particular promotion. Those terms will apply to the relevant promotion in addition to these Terms.

12. Delivery territory

Orders through alivebrewing.sg are accepted for delivery within Singapore only unless we expressly agree otherwise in writing.

We do not currently offer international delivery through the consumer website.

You must provide a complete and accurate delivery address, recipient details and contact number where requested. We are not responsible for delays or failed delivery caused by materially inaccurate or incomplete information supplied by the customer, subject to applicable law.

13. Delivery timing

We generally aim to deliver orders within one to two business days after receiving an order.

Subject to availability and operational conditions:

Orders received before 3:00 p.m. are generally scheduled for delivery on the next working day;
Orders received after 3:00 p.m. on Friday and before 3:00 p.m. on Monday are generally scheduled for delivery on Tuesday;
Orders received after 3:00 p.m. on the day before a public holiday are generally scheduled for delivery two working days after the public holiday, subject to the weekend rule above.

Delivery dates and times are estimates unless we expressly confirm otherwise. Delays may arise because of stock availability, high order volumes, weather, traffic, courier operations, public holidays or events outside our reasonable control.

We will use reasonable efforts to notify you of a material delay that becomes known to us.

More detailed delivery arrangements are set out in our Shipping Policy.

14. Delivery recipients and age requirements

The purchaser must ensure that the delivery arrangement complies with applicable alcohol age restrictions and that an eligible recipient can receive the order where required.

We or our delivery provider may request identification or refuse or postpone delivery when reasonably necessary to comply with applicable law, licence conditions or age-verification requirements.

If delivery cannot be completed because the purchaser or recipient fails to satisfy an applicable age or identity requirement, the order may be treated as a failed delivery. Reasonable redelivery or return costs may apply as described in our Shipping Policy and Return and Refund Policy.

15. Default unattended delivery

If no recipient is present at the delivery address when delivery is attempted, the order will, by default, be delivered unattended at the recipient’s doorstep or another reasonably suitable location at the provided delivery address.

By placing an order, you acknowledge and authorize this default unattended-delivery arrangement unless:

You provide different delivery instructions that we accept;
You contact us before dispatch to request attended delivery;
The delivery personnel reasonably determine that the location is unsafe, exposed, inaccessible or unsuitable;
The delivery cannot be completed securely;
Age or identity verification is reasonably required; or
Unattended delivery would be inconsistent with applicable law, liquor-licence conditions or other regulatory requirements.

When completing an unattended delivery, the delivery personnel will ordinarily:

Leave the order at the recipient’s doorstep or another reasonably suitable location at the delivery address;
Take a photograph documenting the location and completion of delivery; and
Record or transmit delivery confirmation through the applicable delivery system.

The customer is responsible for:

Providing a complete and accurate delivery address;
Ensuring that the delivery location is reasonably secure and sheltered;
Providing any necessary access instructions;
Ensuring that the unattended order will not be accessible to an individual younger than 18 years; and
Collecting the order promptly after receiving delivery confirmation.

Subject to applicable law and any rights concerning goods that are damaged, defective, incorrectly supplied or not actually delivered, an order is considered delivered when it has been left at the provided delivery address and documented by the delivery personnel.

Risk in the order passes to the customer upon completion of the documented unattended delivery. Alive Brewing is not responsible for theft, loss, unauthorized access, deterioration or damage occurring after documented delivery, except to the extent caused by Alive Brewing’s breach, negligence or other liability that cannot lawfully be excluded.

If unattended delivery cannot reasonably or lawfully be completed, the delivery may be treated as unsuccessful. We may contact the customer to arrange redelivery, and reasonable redelivery or return charges may apply.

16. Risk and ownership

Subject to applicable law and your rights relating to damaged, defective, incorrect or missing goods:

Risk in the products passes to you when the order is delivered to the stated address, an authorized recipient or an expressly authorized unattended-delivery location; and

Ownership of the products passes after we have received full payment and delivery has occurred.

For an unattended delivery, photographic or electronic delivery confirmation may be used as evidence that the order was delivered, but it does not remove any right you may have in relation to an order that was not actually delivered or was supplied damaged, defective or incorrectly.

17. Cancellations, returns and refunds

Cancellations, returns, replacements, credits and refunds are governed by our Return and Refund Policy.

In summary:

Beer and other consumable products cannot be returned for change of mind;
Eligible non-consumable merchandise may be returned within the stated return period;
Damaged, defective, leaking, incorrect or missing products should be reported within the stated reporting period; and
Cancellation requests must be made before packing or dispatch, subject to our ability to stop fulfilment.

If there is any inconsistency between this summary and the published Return and Refund Policy, the more specific applicable provision of the Return and Refund Policy will apply, subject to mandatory law.

18. Acceptable use

You must not use the website:

For an unlawful, fraudulent or abusive purpose;
To purchase or attempt to purchase alcohol while younger than 18 years;
To purchase alcohol for supply to an individual younger than 18 years;
To impersonate another person;
To provide false or misleading information;
To interfere with the website’s security or operation;
To introduce malicious code;
To scrape, copy or extract website content through unauthorized automated means;
To infringe intellectual-property or privacy rights; or
To conduct unauthorized commercial resale.

We may restrict access, cancel an order or close an account where reasonably necessary in response to prohibited conduct, fraud, security threats or legal requirements.

19. Intellectual property

The website and its content—including the Alive Brewing name, branding, artwork, can designs, photographs, graphics, copy, videos and website design—are owned by or licensed to Alive Brewing and are protected by applicable intellectual-property laws.

You may access and use the website for personal, non-commercial shopping and information purposes.

You must not reproduce, distribute, modify, publish, sell, license, create derivative works from or commercially exploit our content without prior written permission, except as permitted by law.

No right, title or interest in our intellectual property is transferred to you through your use of the website or purchase of a product.

20. Third-party services and links

The website may contain links to or integrations with third-party websites and services, including payment, account, delivery and social-media services.

External links are provided for convenience. We do not control third-party websites and are not responsible for their content, availability, security or privacy practices, subject to applicable law.

Your use of a third-party service may be governed by that provider’s own terms and policies.

21. Website availability

We may maintain, update, modify or temporarily suspend all or part of the website.

We do not guarantee that the website will always be uninterrupted or free from technical errors. We will use reasonable efforts to maintain the service but may restrict access where necessary for maintenance, security, legal compliance or circumstances outside our reasonable control.

Temporary website unavailability does not affect an order already accepted, except where fulfilment is prevented by circumstances addressed elsewhere in these Terms or applicable law.

22. Disclaimers

We aim to keep the website and product information accurate and current.

To the extent permitted by law, the website is provided on an “as available” basis. We do not guarantee that every function will always be available or that the website will be free from every error, interruption or security risk.

Nothing in these Terms excludes any guarantee, condition, representation, right or remedy that cannot lawfully be excluded.

23. Limitation of liability

Nothing in these Terms excludes or limits liability for:

Death or personal injury caused by negligence;
Fraud or fraudulent misrepresentation;
Wilful misconduct;
Breach of a statutory right that cannot legally be excluded; or
Any other liability that cannot lawfully be excluded or limited.

Subject to the above and to the extent permitted by law, Alive Brewing will not be liable for indirect, incidental or consequential loss that was not reasonably foreseeable when the relevant contract was formed.

For a claim arising from a particular consumer order, our aggregate contractual liability will not exceed the amount paid for the affected order, except where a higher liability is required by law.

You remain responsible for using and storing products appropriately, following product information and consuming alcohol responsibly.

24. Events outside reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, transport disruption, government action, emergency conditions, labour disruption, utility or telecommunications failure, cyber incidents, supplier disruption or courier interruption.

This provision does not remove any refund, termination or other right that applies under mandatory law or another provision of these Terms.

25. Privacy

Our collection, use, disclosure and protection of personal data are governed by our Privacy Policy.

By using the website, you acknowledge that personal data may be processed as described in that policy, subject to applicable data-protection law.

26. Suspension and termination

You may stop using the website at any time.

We may suspend or terminate access to the website or a customer account where reasonably necessary because of:

A serious or repeated breach of these Terms;
Fraud or suspected fraud;
Security risk;
Unlawful conduct;
Underage purchasing;
Non-payment; or
A legal or regulatory requirement.

Termination does not affect rights and obligations accrued before termination.

27. Changes to these Terms

We may revise these Terms to reflect changes in law, regulation, licensing, operations, technology or website functionality.

The current version will be published on this page with its effective or last-updated date.

Revised Terms apply prospectively from publication. A material revision will not retroactively change the terms governing an order already accepted unless the change is legally required or agreed with you.

28. Severability

If a provision of these Terms is held to be unlawful, invalid or unenforceable, it will be interpreted or limited to the minimum extent necessary. The remaining provisions will continue to apply.

29. No waiver

A delay or failure to enforce a provision does not waive the right to enforce it later.

30. Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent.

We may transfer our rights or obligations as part of a genuine business transfer, restructuring or legal requirement, provided that doing so does not reduce mandatory consumer protections.

31. Governing law and jurisdiction

These Terms and purchases made through alivebrewing.sg are governed by the laws of Singapore.

The courts of Singapore have jurisdiction over disputes arising from these Terms or purchases made through the website, subject to any mandatory right to bring a claim before another competent forum.

Nothing in this section prevents the parties from attempting to resolve a dispute through direct discussion or an appropriate mediation or consumer-dispute process.
